Booking Photo Policy in Marion County
Marion County no longer provides booking photos on its jail roster. This change took effect on January 1, 2022. It was the result of Oregon House Bill 3273. The law limits when booking photos can be shared with the public. Before this law, mugshots were part of the online roster. Now they are not shown.
HB 3273 was passed to address concerns about the misuse of booking photos. Many people were booked but never convicted. Their photos still appeared online. The law now prevents this. Marion County recent bookings still show names, charges, and dates. But the photos are no longer part of the public listing.
If you need a booking photo for a legal matter, contact the Marion County Sheriff's Office. They may release photos under certain conditions. The phone number is (503) 588-8595. You can also submit a public records request. The records office is at 100 High Street NE in Salem.
Note: The removal of booking photos applies only to the public jail roster. Law enforcement agencies still have access to these images for official use in Marion County.

Oregon law allows some records to be expunged. This means they are sealed or removed from public view. Not all records qualify. The process depends on the type of charge, the outcome, and your history. Marion County handles expungement through the Circuit Court.
For misdemeanors, you must wait three years after the case is closed. All fines must be paid. All probation must be done. All restitution must be cleared. You cannot have any pending charges.
